A Moi University student, David Oaga Mokaya is set to face a full trial after being charged with publishing false information concerning President William Ruto, stemming from a controversial social media post.
The core of the case revolves around an image shared by Mokaya on his X account, “Landlord @bozgabi,” which depicts a funeral procession featuring a casket draped in the Kenyan flag. The image is accompanied by captions that falsely suggest it is President Ruto’s funeral.
The court’s decision to proceed with the trial comes after prosecutors confirmed that the Director of Public Prosecutions (DPP) has not issued any instructions to withdraw the charges.
Earlier, the DCI, had applied for a 21-day detention to allow sufficient time for comprehensive investigations, including forensic analysis of electronic devices seized from Mokaya.
The court has now scheduled the trial to commence on May 29th. Mokaya’s defence team led by lawyer Dastan Omari did not object and agreed to proceed with the matter. The case has also raised concerns from the Law society of Kenya, who also questioned the possibility of president Ruto testifying, and also questioned the jurisdiction of the court.
