High Court Suspends Rollout of New Digital IDs

The High Court of Kenya has issued a suspension on the rollout of the 3rd generation identity cards, known as Maisha Namba, Maisha digital cards, and Maisha database which were to consolidate existing data into a single register.

This decision comes after the Haki na Sheria Initiative raised concerns about potential constitutional violations and data privacy risks that are associated with the rollout of the cards. For instance, the government confirmed mass collection, processing and storage of data with plans to issue an UPI which Haki argues its not constitutionally accurate.

According to the Lobby, as reported by business daily, this procedure poses a great risk to the members of the public as it predisposes some of their personal information with a likelihood of their personal data being breached as their is no clear records of how the data will be protected.

Additionally, the rollout is likely to widen the already the existing exclusion of the marginalized citizens

Justice Lawrence Mugambi emphasized the need to address these issues before proceeding.

The judge said, “The court is satisfied that based on the latest disclosure, an order staying any further and/or continued implementation pending the hearing and determination of this application ought to issue”

Further hearing before the High court scheduled for October 4th. The Maisha Number suspension highlights significant concerns regarding the inclusivity and security of the digital ID system.
