A blogger was arrested over allegedly defaming Kirinyaga County Governor Anne Waiguru, on a Facebook post.
According to Kirinyaga Country Criminal Investigations Officer, Bernard Korir, the blogger was arrested and taken to the Kerugoya Police Station for interrogation. This was after Governor Waiguru recorded statement with Directorate of Criminal Investigations prompting the police to launch investigations.
The blogger, however, denied defaming the governor claiming that his Facebook account had been hacked. If found guilty, he could be charged for publishing false information and misleading data under the computer misuse and cybercrimes law.
Section 23 states: “A person who intentionally publishes false, misleading or fictitious data or misinforms with the intent that the data shall be considered or acted upon as authentic, with or without any financial gain, commits an offence and shall, on conviction, be liable to a fine not exceeding Ksh. 5million or to imprisonment for a term not exceeding two years, or to both.”
