Meshack Kipchirchir Korir was charged with ethnic contempt for publishing what the National Cohesion and Integration Commission (NCIC) considered criminal.
It is alleged that the Facebook post he made urged certain members to go work from their native homes, which the police said “was calculated to stir up ethnic hatred between Kalenjin community and the Kikuyu community.”
The offence of offence of ethnic or racial contempt in Section 62 (1) of the NCIC Act reads;
Any person who utters words intended to incite feelings of contempt, hatred, hostility, violence or discrimination against any person, group or community on the basis of ethnicity or race, commits an offence and shall be liable on conviction to a fine not exceeding one million shillings, or to imprisonment for a term not exceeding five years, or both.
The police charge sheet indicates he was arrested on 16th July and charged on 17th July before a Magistrate court in Eldoret.
He pleaded not guilty and was released on a sh500, ooo cash bail.
