DPP files notice to appeal criminal defamation judgment

The Director of Public Prosecutions (DPP) has filed a notice to appeal the criminal defamation judgment by Justice Enoc Chacha Mwita.

In the notice, DPP says he is “dissatisfied with the entire judgment and orders of the court dated 26th April, 2017”.

In the Judgement, Justice Mwita declared section 194 of the Penal Code as unconstitutional. The case came about after Blogger Robert Alai was sued for criticizing the President online.

It is standard procedure to file a notice of appeal. However, it does not follow that the appeal will be lodged.
